Hello everyone, Recent correspondence suggests there may be some uncertainty about how the HelpOS candidate directories and comparisons work. Since this candidate list is publicly archived, I want to provide a straightforward clarification for mayoral candidates, Council candidates, and residents following the election. HelpOS provides four related candidate-information and comparison resources: * Mayor candidate directory https://helpos.ca/mayor: Comparable profiles of every registered mayoral candidate, including registration, background, public positions, contact information, and sources. * Council candidate directory https://helpos.ca/council: Comparable profiles of every registered Council candidate, including background, priorities, public record, contact information, and sources. * Mayor role and experience comparison https://helpos.ca/mayor/role-and-experience: A sourced assessment of candidates’ preparation for City Council, Grey County Council, and the mayor’s distinct statutory responsibilities. * Mayor and Council issue comparison https://helpos.ca/council/compare?sort-mayor=information&sort-council=information#mayor-candidates-chart: Separate mayoral and Council charts comparing documented positions on current municipal outcomes. Together, these pages provide several ways to examine the candidates: basic directory information, relevant background and public records, preparation for the responsibilities of each office, and documented positions on issues raised during the election. Each resource has its own stated purpose and should be understood within that scope. *Publisher disclosure* I maintain HelpOS and am a registered candidate for Mayor of Owen Sound. This is disclosed prominently on the comparison page. HelpOS contains both clearly identified candidate-published campaign pages and source-based civic information pages covering every registered candidate. The directories and comparison use the same published evidence rules for all candidates, including me. *Three kinds of content* The candidate information is divided conceptually into three categories: 1. *Public facts and records:* Registration, previous elected service, professional background, Council activity, public statements, and other verifiable information. 2. *Attributed summaries:* HelpOS describes candidates’ publicly expressed positions in original wording and links to campaign publications, questionnaires, interviews, Council records, or other sources. 3. *HelpOS analysis:* The comparison applies its published methodology to the evidence. Analytical judgments are HelpOS commentary, with the publisher and methodology disclosed. Candidate statements remain attributed to the candidate. Copyright in a photograph, graphic, or particular passage is separate from the facts it depicts or communicates. A candidate may hold rights in the creative expression of campaign material, while the underlying biographical facts, public actions, policy positions, and other verifiable information remain factual material that can be reported and summarized in original wording. HelpOS therefore treats photographs, copied campaign prose, graphics, and other creative works separately from public facts. It uses original summaries and source links wherever practical, and a rights holder may identify a specific copied creative work for prompt review. *How the evidence model works* Each column describes a municipal outcome and the elements used to assess it. Different credible approaches can fully satisfy the same outcome. Expanded entries explain each candidate’s own method, conditions, and implementation details. The symbols describe the documented relationship between a candidate’s published position and the stated outcome: * ✓ indicates documented support for the outcome and its core elements. * ≈ indicates qualified or partial support, a shared goal with conditions, or an unresolved element. * × indicates documented opposition to the outcome or a central element. * ? indicates that sufficient published evidence has yet to be located. Evidence coverage measures how much published information is available. Candidate quality and the final voting decision remain with each voter. Assessments depend solely on attributable evidence and the published methodology. Candidates can improve the accuracy and completeness of their entries by submitting additional sources or qualifications. *Why the mayoral comparison examines several domains* The mayoral criteria follow the legal structure of the office. Section 224 of Ontario’s /Municipal Act, 2001/ establishes Council’s responsibilities for public representation, policies and programmes, municipal services, accountability, transparency, and financial integrity. Sections 225 and 226.1 establish additional duties for the mayor as head of Council and chief executive officer. These include chairing meetings, providing Council leadership, representing the municipality, promoting public involvement, and supporting the community’s economic, social, and environmental well-being. Owen Sound’s mayor also serves on Grey County Council. Grey County Council consists of the mayor and deputy mayor from each of its nine member municipalities. County decisions affect housing and homelessness services, Ontario Works, child care, paramedic services, long-term care, County roads, planning, and economic development. Owen Sound is also subject to Part VI.1 of the /Municipal Act, 2001/. The strong-mayor provisions include responsibilities involving the budget, senior administration, organizational structure, committees, and provincial-priority matters. Section 284.16 assigns preparation of the proposed municipal budget to the mayor. Owen Sound’s 2026 budget direction confirms that the budget duty remains personally with the mayor and is ineligible for delegation. This is why the mayoral comparison separately examines City Council responsibilities, County responsibilities, and the distinct statutory duties of the mayor. The Council comparison therefore has its own criteria corresponding to the collective responsibilities assigned to Council under section 224 of the /Municipal Act, 2001/. The nine current outcomes cover transparency, public participation, local representation, housing, sustainable savings, transit, community safety, water and wastewater services, and the local economy. These subjects reflect matters within municipal authority and issues raised during the 2026 election through: * Conversations with residents at their doors and in public forums * Candidate campaign materials and interviews * Council records and previous election statements * The HelpOS candidate questionnaire * The Concerned Owen Sound Taxpayers questionnaire Residents have raised questions about property taxes, service costs, communication with City Hall, participation before decisions, housing affordability, homelessness and public safety, transit reliability, water and wastewater rates, development, and the ability of residents and young people to remain in Owen Sound. The comparison translates those concerns into assessable public outcomes. Candidates may reach those outcomes through different policies, partnerships, service models, timelines, or implementation plans. *Legal background and where HelpOS fits* Canadian copyright guidance explains that public facts are separate from the creative wording, photographs, or graphics used to communicate them. Facts may be reported in original wording, while copyright protects the particular creative expression. (Canadian Intellectual Property Office https://ised-isde.canada.ca/site/canadian-intellectual-property-office/en/gu...) Canadian law also permits fair use of copyrighted material for purposes such as reporting, criticism, or review when the use is fair and the source is credited. (Copyright Act, sections 29.1 and 29.2 https://laws-lois.justice.gc.ca/eng/acts/c-42/page-6.html) In CCH Canadian Ltd. v. Law Society of Upper Canada, 2004 SCC 13 https://decisions.scc-csc.ca/scc-csc/scc-csc/en/item/2125/index.do, the Supreme Court of Canada described fair dealing as a user’s right. In Grant v. Torstar Corp., 2009 SCC 61 https://decisions.scc-csc.ca/scc-csc/scc-csc/en/item/7837/index.do, the Court recognized protection for responsible communication about matters of public interest. In WIC Radio Ltd. v. Simpson, 2008 SCC 40 https://www.canlii.org/en/ca/scc/doc/2008/2008scc40/2008scc40.html, it confirmed protection for fair comment when an opinion concerns a public matter and is grounded in established facts. HelpOS follows this framework by: * Publishing factual election information about every registered candidate * Writing original summaries of publicly expressed positions * Attributing statements and linking to their underlying sources * Separating candidate statements from HelpOS analysis * Explaining the methodology used for analytical classifications * Providing a visible publisher disclosure and correction process * Reviewing specific requests concerning copyrighted photographs or other creative works Municipal candidates’ qualifications, public records, and policy positions are matters of direct public interest during an election. HelpOS reports those facts, gives readers access to the supporting evidence, and presents any analytical conclusions as disclosed HelpOS commentary. The legal authorities above explain how factual reporting, fair use, responsible public-interest communication, and fact-based comment can coexist with copyright protection for photographs, graphics, and original campaign wording. These protections depend on fairness, accurate sourcing, attribution, and a clear distinction between verified information and analytical opinion. HelpOS applies those safeguards so residents can compare candidates using documented information while each candidate’s creative work remains a separate copyright consideration. Every candidate is welcome to submit factual corrections, important qualifications, platform statements, websites, interviews, or additional sources to |andrii@zvorygin.ca|. Thank you, Andrii Zvorygin Candidate for Mayor of Owen Sound HelpOS maintainer
